Terms & Conditions
These Terms cover both the Wayworn iOS app and this website (the list-builder at wayworn.app). The same document governs both — they aren’t legally separate.
1. Acceptance of terms
By downloading, installing, or using the Wayworn iOS app (“the App”), or by signing in to or using this website (“the Website”, together “Wayworn”), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use Wayworn.
2. Description of service
Wayworn is a personal travel-tracking experience.
- The App analyses GPS metadata from your photos to identify visited countries, locations, and points of interest. Core data processing occurs on your device. The App uses Apple services including MapKit, WeatherKit, CloudKit, and HealthKit as described in the Privacy Policy. When iCloud Sync is enabled, your data is stored in your personal iCloud account.
- The Website is a small companion that lets you build curated lists of places (mountain peaks, filming locations, road-trip routes) and export them as GeoJSON files for the App to import. The list-builder requires sign-in so we can associate lists with your account and let you share them with a link.
3. Data attribution
Wayworn uses geographic and point-of-interest data derived from OpenStreetMap® contributors. OpenStreetMap® is open data, licensed under the Open Data Commons Open Database License (ODbL) by the OpenStreetMap Foundation (OSMF).
You are free to copy, distribute, transmit, and adapt the OpenStreetMap data, as long as you credit OpenStreetMap and its contributors. For full licence details, visit openstreetmap.org/copyright.
Country boundary data, place names, and points of interest displayed within Wayworn may originate from or be derived from OpenStreetMap data. The Website’s map tiles are served by OpenFreeMap, which redistributes OpenStreetMap data under the same ODbL terms.
4. Apple services (the App)
The App integrates with the following Apple services, each governed by Apple’s own terms and privacy policy:
- MapKit — for maps, reverse geocoding, location search, and nearby points of interest
- WeatherKit — for retrieving weather data for your trips (coordinates are sent to Apple)
- CloudKit / iCloud — for optional syncing of your data across your devices via your iCloud account
- HealthKit — for optionally reading step count, walking distance, and flights climbed for your trips
The App does not send your data to any service other than Apple’s.
5. Third-party services (the Website)
The Website uses the following providers, each governed by their own terms and privacy policy:
- Apple Sign-In and Google Sign-In — used only to authenticate you when you choose them.
- Resend — used to send the email-based verification and password-reset messages.
- Vercel— hosts the Website. The hosting provider sees only the information needed to serve requests (e.g. IP addresses, request paths).
- Neon — Postgres database, used to store your account row and any lists you create.
- OpenFreeMap— serves the map tiles displayed on the Website’s editor and shared-list pages.
6. No warranty & disclaimer of accuracy
Wayworn and all associated data — including but not limited to maps, country boundaries, points of interest, place names, geographic coordinates, and weather information — are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.
The developer makes no representations or warranties regarding the accuracy, completeness, reliability, or currentness of any geographic data, location information, weather data, health statistics, or point-of-interest data presented within Wayworn. Boundary data may not reflect the latest geopolitical changes, and points of interest may be outdated, incorrectly positioned, or no longer in existence.
Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable UK consumer protection legislation.
7. Limitation of liability
To the maximum extent permitted by applicable law, the developer of Wayworn shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, Wayworn. This includes, without limitation:
- Errors, inaccuracies, or omissions in geographic data, maps, or location information
- Reliance on any data or information provided by Wayworn
- Decisions made or actions taken based on information displayed in Wayworn
- Loss of data, including trip records, visited location history, or saved lists
- Any interruption or cessation of Wayworn’s functionality
- Issues arising from iCloud synchronisation, including sync delays or data conflicts
Nothing in these terms excludes or limits the developer’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
8. Photo library modifications (the App)
The Geotag Tool allows you to write GPS coordinates to photos and videos in your library that are missing location data. This modifies the original media metadata in your photo library. By using this feature, you acknowledge that these changes may be irreversible and the developer is not responsible for any unintended modifications.
9. Generated content & sharing
The Trip Montage feature in the App generates video content from your trip photos entirely on your device. Generated videos are saved locally and are your responsibility to manage, share, or delete. The developer is not responsible for how generated content is used or distributed after creation.
Backup files created by the App contain your location history, trip data, and photo metadata (including GPS coordinates). You are responsible for where you save or share these files. If saved to a cloud service, your data will be stored on that service.
On the Website, when you mark a list as public it gets an unguessable share token in its URL. Anyone who has that URL can view the list. Switching the list back to private rotates the token and the old URL stops working — but if the URL was shared widely before, you may already have distributed list content you didn’t intend to keep private.
10. Not a navigation or safety tool
Wayworn is designed for personal travel logging, reminiscence, and curation only. It is not intended to be used as a navigation, wayfinding, or safety tool. Do not rely on Wayworn for travel planning, border-crossing decisions, or any situation where inaccurate location data could result in harm.
11. Third-party data
Wayworn may display data sourced from third parties, including OpenStreetMap contributors. The developer does not control and is not responsible for the accuracy or availability of third-party data. Third-party data is subject to its own respective licences and terms.
12. User responsibility
You acknowledge that photo metadata (including GPS coordinates) is generated by your device and camera. The accuracy of location detection within the App depends on the quality and accuracy of this metadata, which is outside the developer’s control. On the Website, you are responsible for the content you add to lists you create and for any place you choose to share publicly.
13. Community content & objectionable material
Some lists are shared publicly by other users (“community content”). There is zero tolerance for objectionable content or abusive users. You agree not to publish, share, or upload content that is unlawful, hateful, harassing, threatening, defamatory, obscene, infringing, or otherwise objectionable.
Every community list can be reported from within the product, and you can block a creator to hide their content from your community feed. We review reports and remove content that violates these Terms — and may suspend or remove the responsible account — typically within 24 hours of a report. By sharing content publicly you grant us the right to display, moderate, and remove it.
14. Account suspension & termination
We may suspend or terminate Website accounts that violate these Terms, abuse the service, or harm other users. If you’d like to close your own Website account, the “Delete account” option in Settings removes your account and your lists; this can’t be undone.
15. Changes to terms
The developer reserves the right to modify these Terms and Conditions at any time. Continued use of Wayworn following any changes constitutes acceptance of the revised terms.
16. Governing law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident, and nothing in these terms affects your rights as a consumer to rely on such mandatory provisions.
